Terms of Use

These are the terms you agree to when you apply to or take part in the Mālamalama Center program through this platform. We have tried to keep them short and plainly written.

Acceptance

By creating an account, submitting an application, or using any feature of this platform, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the platform.

Who we are

This platform is operated by Mālamalama Farm and Center, a 501(c)(3) nonprofit charitable organization (EIN 26-1769632) on Maui, Hawaiʻi — also known as Mālamalama Sustainability Center. Write to us at P.O. Box 653, Makawao, HI 96768, or email info@malamalama.org.

What this is

A free, place-based program for emerging sustainable entrepreneurs and regenerative farmers in Maui — applications, mentorship, lessons, and community. The program is supported in part by the County of Maui Office of Economic Development.

Eligibility

  • You must be at least 16 years old.
  • You must be a resident of Maui or otherwise able to participate in this place-based program. We verify identity and residency through documents you provide during the application.
  • If you are under 18, please review these Terms and the Privacy Policy with a parent or guardian before applying.

Your account

Keep your sign-in credentials private. Use accurate information. Use only one account per person. If you think someone is using your account without permission, contact us right away.

Acceptable use

While using the platform, please:

  • Treat other members, mentors, and staff with respect.
  • Do not harass, discriminate against, or impersonate anyone, and do not post hateful, threatening, or sexually explicit content.
  • Do not post anything unlawful, anything that infringes someone else’s rights, or anything you do not have permission to share.
  • Do not try to scrape, attack, or otherwise abuse the platform or its infrastructure.

We may remove content or end participation that materially violates these expectations.

Your content

Your application answers, references, assignment submissions, community messages, and other things you submit through the platform remain yours. By submitting them, you give us a limited license to store and use them within the program — for application review, program administration, communication with you, and similar purposes. We do not sell your content and we do not use it for advertising.

Admission and continued participation

Admission is at our discretion, based on your application, our capacity, and the fit between you and the program. We may end your participation if you materially violate these Terms or program guidelines, or if continued participation would not be safe or appropriate for you or others.

The program experience

We will deliver the program in good faith using reasonable professional care. The curriculum, mentors, schedule, and platform features may change over time. We make no specific guarantee about outcomes — including job placement, business success, or income.

Intellectual property

Our curriculum, lesson materials, written content, and the platform itself are owned by Mālamalama Farm and Center (or our licensors). You may use these only within the program; please do not redistribute them without our written permission. Your own contributions remain your own as described above.

Disclaimers

The platform is provided on an “as is” and “as available” basis. While we aim for good uptime and reliability, we do not promise it will always be uninterrupted or error-free. The program and any information shared through it are for educational purposes; they are not legal, financial, medical, or regulatory advice.

Limitation of liability

To the fullest extent allowed by Hawaiʻi law, our total liability to you arising from your use of the platform will not exceed one hundred U.S. dollars (USD 100). We are not liable for indirect, incidental, or consequential damages. None of this limits liability that cannot be limited under applicable law.

Ending your participation

You can ask us to close your account at any time — email info@malamalama.org and we will help. See the Privacy Policy for what happens to your information when you do.

Governing law

These Terms are governed by the laws of the State of Hawaiʻi, without regard to its conflict-of-law principles. Any dispute will be brought in the state or federal courts located in Hawaiʻi.

Changes to these terms

If we update these Terms, we will change the effective date at the top and, for material changes, let you know by email before they take effect. By continuing to use the platform after a change, you accept the updated Terms.
